Phoenix does not guarantee or warrant any specific results or outcomes from the use of our Services.
You acknowledge and agree that Phoenix and its coaches, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Phoenix has advised of the possibility of such damages), resulting from:
a. The use or the inability to use the Service; b. Any actions taken or decisions made based on the information, guidance, or advice provided through the Service; c. The cost of procuring substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Service; d. Unauthorized access to or alteration of your transmissions or data; e. Statements or conduct of any third party on the Service; f. Any other matter relating to the Service.

Terms and Conditions for Speaking Opportunity Event
1. Introduction
These Terms and Conditions ("Agreement") set forth the general terms and conditions of your use of the speaking opportunity offered by [Clare Garner] ("Event Host," "we," "us," or "our") for a fee at events organized by us. By accepting the opportunity to speak at our event, you ("Speaker," "you," or "your") agree to be bound by these Terms and Conditions.
2. Fees and Payment
2.1. The Speaker agrees to pay a non-refundable fee of [£99 or £499 depending on chosen speaker offer] for the opportunity to speak as part of the event. This may be pre-recorded or live depending on which option is agreed upon booking.
2.2. Payment must be made in full prior to the event date. Failure to make timely payment may result in the forfeiture of the speaking slot.
3. Speaking Slot and Event Details
3.1. The Event Host will provide the Speaker with a specific time slot and location (whether virtual or physical) for the talk, live or pre-recorded, along with other relevant event details.
3.2. The Speaker agrees to comply with any requirements provided by the Event Host, including but not limited to deadlines for submitting presentation materials or promotional content.
4. No Guarantee of Audience Size or Reach
4.1. The Event Host does not make any representations or guarantees regarding the number of attendees, viewers, or the overall reach of the event.
4.2. The Speaker acknowledges that the size of the audience and the engagement level is subject to various factors outside the Event Host’s control, and no liability will be assumed by the Event Host for any perceived or actual low uptake or limited reach.
4.3. The Speaker understands that no refunds or credits will be issued based on dissatisfaction with the audience size or event exposure.
5. No Liability for Outcomes
5.1. The Event Host is not responsible for any outcomes or results of the Speaker's presentation, including but not limited to the reaction of the audience, feedback received, or any follow-up actions taken by attendees.
5.2. The Speaker agrees to release the Event Host from any claims, damages, or losses arising from the performance or outcome of their participation in the event.
6. Intellectual Property
6.1. The Speaker retains ownership of any intellectual property rights in the content of their presentation.
6.2. The Speaker grants the Event Host a non-exclusive, royalty-free license to use, distribute, and promote the presentation materials for event-related purposes, including the replay - inclusive of,but not limited to marketing, event recordings, and promotional content.
7. Cancellation and Postponement
7.1. The Event Host reserves the right to cancel or reschedule the event at any time for reasons beyond its control, including but not limited to low registration, technical issues, or unforeseen circumstances.
7.2. In the event of cancellation, the Speaker will be offered an alternative speaking opportunity at a future event, or a refund of the fee at the Event Host's discretion.
8. Speaker Responsibilities
8.1. The Speaker is responsible for preparing and delivering the presentation in accordance with the event schedule and guidelines.
8.2. The Speaker warrants that their presentation will not infringe upon any intellectual property rights, contain offensive or unlawful content, or otherwise violate the rights of third parties.
9. Indemnification
The Speaker agrees to indemnify, defend, and hold harmless the Event Host from and against any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from any breach of these Terms and Conditions or the Speaker's participation in the event.
10. Limitation of Liability
To the fullest extent permitted by law, the Event Host shall not be liable for any indirect, incidental, special, or consequential damages arising from or in connection with the Speaker's participation in the event, including but not limited to loss of revenue, audience dissatisfaction, or damage to the Speaker's reputation.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom and the country you reside in, without regard to its conflict of laws principles.
12. Entire Agreement
This Agreement constitutes the entire understanding between the Speaker and the Event Host regarding the speaking opportunity and supersedes all prior or contemporaneous communications, agreements, and understandings.
